Business Lesson #1 - How to find a good Attorney

First off, by no means am I an attorney. This is NOT legal advice but only my opinion on how to find a good attorney and what I think needs to be done to have a good legal structure. Just wanted you to know that! Ok so back to business.
Finding a good attorney is crucial to a businesse’s success. Do not think for one minute that you can just go into a business without first having a legal structure in place. Having a legal structure is important in the following ways:
1.) It protects you from liability. Say you own a landscaping company and you accidently shoot a rock into someone’s window. If they are half way decent people they will let it slide given you fix the window. Now, say you hit someone over the head with a rock. This is a little different story since it cannot be fixed with a new pane of glass. Most people will sue you in a minute. If you are protected by a corporation or an LLC they will have to sue your company and not you. This could save your house, car, T.V., you name it. Some sort of legal protection is very important.
2.) You receive extra tax benefits based on the type of company you have. Depending on where you live these laws might be different so make sure you speak with an attorney and or accountant for this one.
Ok, now that I am off my soap box here we go. To find a good attorney do the following three things and you should have no problem.
1.) Join your local Chamber of Commerce. The Chamber here where I live has a meeting every two months that involves going out and meeting new people. We meet in a banquet area and almost without exception there is a lawyer offering his or her services. Because we are all Chamber members the people there usually offer discounts. So not only would you find a good lawyer there you would find one offering a discounted service.
2.) DO YOUR HOME WORK. Often times you think you have found a lawyer and you are on your way to success. Well, in case you didn’t know there are about 5,000 different types of lawyers. My advice would be to find a lawyer dealing with new business development. You want a legal professional that knows how to draw up partnership agreements, contracts, non-disclosure forms and so on. If you have a real estate attorney you might want to look elsewhere. Having someone that specializes in ONE practice is far better than a lawyer of all trades.
3.) Call local businesses that deal in the same business you do. Don’t be shy, call these places and ask them if they can kindly point you in the direction of a good lawyer. Tell them you are starting a new business and you would like to know where to start in regards to law. 99% of the time they will be glad to help you.
If all else fails there is some software you can buy that has pre-made documents on it regarding business ventures. Most of the software I have seen have contracts, partnership agreements, and many others you might need. Please remember not replace an actual lawyer with this type of software. A lawyer went to school for 8 years and is usually up to date with legal changes, software is not.
So, when looking for the right type of lawyer refer back to this site and remember the list I gave you. It will not only save you hours but possibly thousands. Good luck!
